The public communication made by the gambling operators turned into a hot topic once again this October when the National Audiovisual Council (CNA) proposed amendments to the Regulatory Code regarding the audiovisual content of the televised ment for gambling. z2c4u

On this issue, the Remote Gambling Association was among the main advocates for the liberalization of this topic and participated in various debates within the CNA.

Mrs. Odeta Nestor, Chairwoman of the Remote Gambling Association, reiterated in a letter to the National Audiovisual Council a series of suggestions aimed to set the record straight on how gambling ment shall be conducted.

Among the points of view of the Association of Remote Gambling Operators (AOJND), the proposal allowing for the broadcast of ment during live sports events, the lifting of time slot-related restrictions – 23.00 to 20.00.

Odeta Nestor: “By the end of September we sent a letter to the National Audiovisual Council on behalf of the Association I represent, asking the Council to improve the regulations pertaining to the audiovisual content in of the televised ment for gambling. In my opinion, Romania may rally to such EU Member States as Great Britain or Malta where Televised ment for gambling is allowed subject to a minimum legal age of 18 years old and the creation of a responsible media content which shall not impair the integrity of the minors. The AOJND proposal was worded as follows: The ment for gambling is allowed during the sports events broadcast by the Romanian television channels, irrespective of their time slot, subject to the following conditions: – the broadcast of the ment for gambling should begin 30 minutes before the commencement of a sports event and end 30 minutes after the completion thereof. The ment for gambling should only cover the gambling activities that were licensed in Romania.

Another item in our letter refers to the reconsideration of the 11:00 p.m. as the start hour for the TV ment for gambling.  I would like to say the association I represent is totally in favor of setting up reasonable as well as proportional limitations to the broadcast of ment spots on the Romanian television channels, but also considers that the 11:00 p.m. threshold may not be the best form to protect the minors.

I firmly believe in the idea of responsible gambling and, therefore, in media spots containing messages for responsible gambling. The National Audiovisual Council, through its , showed its availability to listen and examine the proposals of the Remote Gambling Association and analyze the regulations from other European jurisdictions, and was to rule on the changes before casting their vote on the final draft.

To conclude, I consider AOJND continued, successfully, the debates required by the gambling industry, in collaboration with the state authorities, thus remaining a key player among the associations in the industry.”Tema comunicărilor publice realizate de organizatorii de jocuri de noroc a revenit în actualitate în contextul în care în luna octombrie a acestui an, Consiliul Național al Audiovizualului a propus spre modificare Codul de Reglementare a conținutului audiovizualului în ceea ce privește publicitatea televizată la jocurile de noroc.

Asupra acestui subiect, Asociația Jocurilor de Noroc la Distanță a fost unul din principalii promotori în liberalizarea acestui subiect, participând la numeroase dezbateri în cadrul CNA.

Președinta Asociației Jocurilor de Noroc la Distanță, doamna Odeta Nestor, a reiterat într-o scrisoare adresată Consiliului Național al Audiovizualului, o serie de sugestii menite să clarifice modul în care se va putea difuza publicitatea în domeniul jocurilor de noroc.

Printre punctele de vedere ale AOJND amintim propunerea care permite difuzarea publicității în contextul evenimentelor sportive transmise în direct, ridicarea restricției de oră – 23.00 la 20.00.

Odeta Nestor: “Am transmis la finalul lunii septembrie o scrisoare adresată Consiliului Național al Audiovizualului,în numele asociației pe care o reprezint, în vederea îmbunătățirii reglementărilor conținutului audiovizual, în ceea ce privește publicitatea televizată a jocurilor de noroc. Consider că România se poate ralia țărilor membre UE precum Marea Britanie sau Malta, acolo unde publicitatea TV a jocurilor de noroc este permisă, luând în considerare vârsta limită de 18 ani și crearea unui content responsabil social, astfel încât să nu afecteze integritatea minorilor. Astfel propunerea AOJND este formulată astfel: Publicitatea la jocuri de noroc este permisă în contextul evenimentelor sportive difuzate la posturile de televiziune din România, indiferent de ora difuzării evenimentelor sportive respective, cu îndeplinirea următoarelor condiții: – publicitatea la jocurile de noroc să fie difuzată începând cu 30 de minute înainte de începerea evenimentului sportiv și încetarea acesteia după maximum 30 de minute de la terminarea evenimentului sportiv. Publicitatea la jocuri de noroc să fie difuzată doar pentru activitățile de jocuri de noroc licențiate în România.

Un alt punct pe care l-am transmis în scrisoare se referă la re-analizarea orei 23.00 , asupra publicității tv în cazul jocurilor de noroc.  Aș dori să transmit că asociația pe care o reprezint susține în totalitate intenția de a impune niște restricții rezonabile și proporționale cu privire la difuzarea spoturilor publicitare la televiziunile din România, considerând totodată că, pragul de ora 23.00 nu reprezintă însă cea mai bună formă de protejare a minorilor.

Cred cu tărie în idea jocului responsabil și astfel, de un conținut de spoturi media care să conțină mesajul privind jocul responsabil. Consiliul Național al Audiovizualului și-a arătat prin membrii săi, disponibilitatea de a asculta și a analiza propunerile Asociației de Jocuri de Noroc la Distanță, dar și analiza asupra reglementărilor din alte jurisdicții europene, rămânând astfel să se decidă asupra modificărilor înainte de a se vota forma finală.

În încheiere, consider că AOJND a continuat cu succes dezbaterile necesare industriei jocurilor de noroc  în colaborarea cu autoritățile statului, menținându-se astfel un principal pion de pe scena mediului asociativ din industrie.”
