2013 was very tumultuous in gambling in general and was marked by the game of State’s power versus private operator. Beyond the usual changes already present in the Romanian legislation, in general, and in gambling, in particular, and the year of 2013 has also marked two firsts:

• In April 2013, the famous MECHANO operation, which consisted of simultaneous controls performed to the gambling means present in authorized venues throughout the country
• Unification of the regulatory authorization and control components under one roof: The National Gambling Office.

There is a theory saying that the two events are generated by the will of a Government, which now is more determined to putting an and to the black money-generating economy, or of the employers ‘ associations, which see their revenues dropping and they are trying, maybe for the first time, to unite in order to eradicate the small clandestine players, microbial survivors of the organizers swallowed up by of the reform of 2009. Regardless of the interpretations generated by the interests of the various parties, one thing remains clear: the deployment of forces of Pantagruelian proportions gave the market a clear message: IT IS POSSIBLE! Therefore, everyone did what they knew better: the legal firms stood close and have faced wave after wave of new ONJN controls. The greyer companies broke up, relocated and are waiting to see what will happen. For the slowest ones, problems had started. Small-scale pirates are the haunted in every nook, and their devices get confiscated one by one.

Overall, the message IT IS POSSIBLE became WE ARE DOING IT, and the results are beginning to show. The good results, especially for the legal market, are: pirates and gray firms show themselves less and less. The bad results also for the legal market are based on the principle that, a legal firm can no longer afford not to pay fines, since its s are blocked and that is that! Tens of thousands of RON are gathered from the short term fines from a market, which is already experiencing a free-fall. Let us not forget that companies are closing, development budgets are frozen, and the players of the industry are thinking twice before investing in a new service. The end of the year brought a joke to our minds, the one with the examination where certain candidates could only enter the circle into the square using more strength. It seems that the new istration in its eager enthusiasm claims something similar from the operators. In a previous material we have mentioned the exaggerated amount of the fines. What will the Office do when the fined operators will close their gates and will lay off hundreds of people? Who are they going to fine then?

The market already experiences exit scenarios. The experience of our neighbors, the Central and Eastern European States – Hungary, Poland, etc., indicates that a large proportion of foreign players left from the market without converting into casino operators, while domestic operators have closed their businesses. Withdrawal of legitimate investors leave room for initiative to the qualified staff, former employees with experience, which find themselves in a critical situation and unable to reorient, and choose to pursue risky, illegal activities. We must it that from time to time, people incline to play, to risk, so that there will always be a market for gambling.

What can be done? Unfortunately, the so blared law changes, are not trying to deal with the common interest of the State and of the operators – development of the industry in a controlled manner -but only to „Patch Up” older and inapplicable laws (e.g. tax on winnings, tickets) and under the appearances of a tax relaxation, they burden the operators even more by increasing specific taxes. Therefore, the change in the law has not been surprising – it was just as we already got accustomed with – but we must wait for European Union notification term. The increase of expenditure on taxes results in lowering the costs of development, the investments in devices and generally lowers the quality of services offered to customers.

Anul 2013 a fost foarte tumultuos în jocurile de noroc în general și a stat sub semnul forței Statului versus operatorul privat. Dincolo de schimbările obișnuite deja în peisajul legislativ românesc, în general, și în jocurile de noroc, în mod special, anul 2013 a marcat și două premiere:

·        În luna aprilie 2013, renumita operațiune MECANO care a constat în verificarea simultană a mijloacelor de joc din locațiille autorizate de pe întreg teritoriul țării.

·        Unificarea componentelor de reglementare, autorizare și control sub un singur acoperiș: Oficiul Național pentru Jocuri de Noroc.

Există speculații dacă cele două evenimente sunt generate de voința unui guvern mai hotărât în a pune punct economiei generatoare de bani negri sau de asociațiile patronale care văd cum li se diminuează veniturile și încearcă, poate pentru prima oară, să se unească în a eradica micii ilegaliști, supraviețuitori bacterieni ai organizatorilor înghițiți de reforma din 2009. Indiferent de interpretările generate de interesele diverselor părți, un lucru rămâne clar: desfășurarea de forțe de proporții pantagruelice a dat un mesaj clar pieței: SE POATE! Așa că fiecare a făcut ulterior ce știa mai bine: firmele legale au strâns rândurile și au înfruntat val după val controalele noului ONJN. Firmele mai gri s-au spart, s-au relocat și așteaptă să vadă ce se întâmplă. Pentru cele mai lente au început problemele. Micii pirați sunt hăituiți din văgăună în văgăună, iar aparatele le sunt confiscate unul după altul.

Per ansamblu, mesajul SE POATE s-a transformat în FACEM, iar rezultatele au început să apară. Cele bune în special pentru piața legală: pirații și firmele gri scot capul mai greu. Cele rele tot pentru piața legală, pe principiul că o firmă legală nu își permite să nu plătească amenzi, i se popresc conturile și gata! Zeci de mii de roni se strâng din amenzi pe termen scurt dintr-o piață și așa în cădere liberă. Să nu uităm că se închid firme, bugetele de dezvoltare sunt înghețate, iar jucătorii din industrie se gândesc de două ori înainte să investească într-o nouă exploatare. Sfârșitul anului ne-a făcut să ne reamintim bancul acela cu examenul unde anumiți candidați nu puteau introduce cercul în pătrat decât cu mai multă forță. Cam așa pare că pretinde operatorilor din piață noua istrație într-un avânt plin de zel. Aminteam într-un material anterior despre cuantumul exagerat al amenzilor. Ce o să se facă Oficiul când operatorii amendați o să închidă porțile și o să concedieze sute de oameni? Cine o să mai rămână de amendat?

Deja în piață se fac scenarii de exit. Experiența statelor învecinate din centrul și estul Europei – Ungaria, Polonia, etc. – ne arată că o mare parte din jucătorii externi s-au retras, fără să se convertească în operatori de cazinouri, de exemplu, iar operatorii interni s-au închis. Retragerea investitorilor legitimi lasă loc inițiativei personalului calificat, foștilor angajați cu experiență și care, văzându-se într-o situație critică și în imposibilitatea de reconversie profesională, optează pentru a-și continua activitatea riscant, ilegal. Trebuie să recunoaștem că oricând oamenii vor fi dispuși să se joace, să riște, astfel că oricând va exista piață pentru jocuri de noroc.  

Ce se poate face? Din păcate mult trâmbițatele schimbări de lege nu încearcă să soluționeze interesul comun al statului și al operatorilor – dezvoltarea în mod controlat a industriei – ci doar să “cârpească” legi mai vechi și inaplicabile (ex: impozit pe câștig, bilete) și sub aparența unei relaxări fiscale, să împovăreze și mai mult operatorii prin majorarea taxelor specifice. De aceea, nici schimbarea legii nu a venit surprinzător – cum ne obișnuisem deja – ci trebuie așteptat termenul de notificare la Uniunea Europeană. Majorarea cheltuielilor cu taxele determină micșorarea cheltuielilor de dezvoltare, a investițiilor în utilaje și în general o calitate mai mică a serviciilor oferite clienților.
