We continue to present to you the new legislative amendments on Budget, Finance and Banks that were adopted by the Committee through the Report on the Bill to amend and supplement the Government’s Emergency Ordinance No. 77/2009 on the organization and operation of gambling, sent to the debate, with no address PL-x 204/2014. 46183w

In relation to the object and its contents, the legislative proposal belongs to the category of organic laws.

6. In article 5 following paragraph 7 three new paragraphs are introduced, paragraphs (8) to (10) with the following wording:

„(8) Equipment dedicated to gambling organizing shall be approved by the Supervisory Committee of the O.N.J.N., can be made by a resident or non-resident, provided that the manufacturer is in possession of the license, in accordance with this emergency ordinance. The conditions that must be met, and the list with dedicated gaming equipment will be governed by order of the President of the O.N.J.N.

(9) The website of the organizer licensed in Romania to conduct remote gaming must contain information in Romanian language, namely: the data of the organizer according to its registration at the Trade Registry Office, including fiscal data, and/or a different identification number, the license issued by the Supervisory Committee of the O.N.J.N., the rules concerning the conduct of gambling stated clear and in an unambiguous way, enumeration procedures for the acceptance of bets, the accumulation and payment of the winnings, the amount of the stakes and the amount of winnings, services, mail data-including a phone number and email address for direct and in a timely manner with the Organizer, the procedure for submission of complaints and referrals to the organizer and to O.N.J.N., as well as other issues that will be covered by the implementing rules of this emergency ordinance.

(10) For the purposes of this emergency ordinance, specialized locations in which one can carry out the activity of gambling, are: the dedicated slot-machine halls, betting agencies and Lotto agencies, poker clubs, bingo halls and casinos. The conditions that must be met for specialized locations will be governed by the implementing rules of this emergency Ordinance. ”

7. Article 6 shall be amended and shall read as follows:

„Article. 6. — (1) The gambling organizer shall mean a legal entity licensed to organize and operate games of chance under the present emergency ordinance and the special regulations. This quality may be acquired by a Romanian legal person constituted under the law or by a legal person duly established in an EU Member State, or in the States signatories to the Agreement on the European Economic Area or to the Swiss Confederation.

(2) The quality of temporary gambling organizer may be acquired by a legal entity established in accordance with paragraph 1.(1) that organizes and operates games of chance for a period of 3 months in tourist resorts, as defined in the annex no. 5 of Government Decision No. 852/2008 approving the rules and criteria for the evaluation of tourist resorts, with its subsequent amendments and additions. ”

8. Article 7 shall be amended and shall read as follows:

„Article. 7-(1) Gambling participant shall mean any physical major person (at least 18 years of age) who wants and has the legal right to participate in gambling permitted under the present emergency ordinances and the special regulations. Participation in the game implies the unconditional acceptance of the rules of the game of chance.

(2) The persons who do not possess on them their acts of identification with photo are prohibited to participate in traditional gambling. ”

9. In article 8, following paragraph (1), a new paragraph (2) is inserted with the following wording:

„(2) A gambling organizer will be required, within a maximum of three working days, in accordance with the procedure laid down in the conditions and rules for the conduct of gambling, to pay winnings and/or offer prizes in kind, to the individual who has presented  chips, tickets or other means to prove profitable, evidence that is given the materially.”

10. Article 9 is amended and shall read as follows:

„Article. 9.- Fraudulent gambling means gambling using approved devices that have had their construction, data or original parameters modified, so to affect the elements of chance or selection procedures. ”

11. In article 10, paragraphs (1) and (3) are amended and shall read as follows:

„Article 10.-(1) Gambling shall be classified as follows: a) lotto games – traditional game – if purely random results of events that consist in roots of numbers, letters, symbols or tickets are used, regardless of the characteristics of the means and procedures used for making a draw (urns, wheels, cups and other means), which is carried out with or without the physical presence of the players. This category includes: lotteries, including snapshot ones, and any game of chance that is carried out with or without the physical presence of the players and that consists is drawing of numbers, letters, symbols, forms or tickets through which various payouts can be obtained, payouts determined by the events taking place with or without the physical presence of the players, with the exception of gambling as defined below;

b) Betting – traditional game – if the results of some events that will occur without the involvement of the organizers are used. Betting is a game of chance in which the participant must indicate the results of some events that do not take place nor are they generated randomly by a independent computer system. This category includes:

(i) mutual bets, in which the prize is distributed to participants declared winners in proportion to the number of wining variants held by each of them, the organizer being engaged only in the process of tax collection and distribution of the amounts set by way of winnings, in accordance with the regulations of the respective game;

(ii) the fixed odds bets,  where the Organizer determines on the basis of its own criteria and brings to the attention of participants the odds of multiplication of the stake where variants are declared the winner, played in accordance with the regulations of the respective game. The value of each gain is fixed by Regulation (fixed amount or multiples of stake) is independent of the total stakes (in the case of bets organized by the holder of the authorization of betting);

(iii) contra-party bets organized within betting agencies, which consists of correspondence between the various betting players, namely the acceptance of a bet placed by a player only insofar as another player identifies who places a bet in inverse sense than initially placed. The value of each win is determined by the players (if the bets are intermediated by the organizer);

c) Casino gambling, – the traditional game – if events occur to a specific game devise, with the physical presence of the participants or without their direct participation. The specific game devices that can be used may be: playing cards, dice, Roulette, roulette game balls and game tables, game devices, including auxiliary facilities thereof, as well as other forms of the game laid down by the implementing rules of this emergency ordinances;

d) Gambling specific to poker clubs – the traditional game – are gambling with cards, referred to as „poker” that takes place exclusively between the participants in specific locations.

e) slot-machine games – the traditional game – there are two types, namely:

(i) slot-machine if the events are held in the physical presence of attendees through machines, equipment and specific installations, which will be operated in locations in which one can carry out the activity of gambling, and the gain is unlimited and depends on the hazard, and

(ii) Electronic devices that assign limited risk winnings, if the events are held in the physical presence of attendees through machines, equipment and specific installations, which will be operated in locations in which one can carry out the activity of gambling, and the gain is unlimited and depends on the hazard;

f) bingo games conducted in game halls – the traditional game – with winnings generated by random items, organized through the use of complex equipment of lottery-type extraction, which are characterized by successive awarding and draws in the physical presence of the players;

g) Bingo games organized via television networks – the traditional game – with earnings generated by random items, organized through the use of complex equipment of lottery-type extraction, which are characterized by successive awards or draws and without the physical presence of the players.

Continuăm să vă prezentăm noile modificări legislative ce au fost adoptate de către Comisia pentru Buget, Finanțe și Bănci prin raportul asupra propunerii legislative pentru modificarea și completarea Ordonanței de urgență a Guvernului nr.77/2009 privind organizarea și exploatarea jocurilor de noroc, trimisă spre dezbatere în fond, cu adresa nr. În raport cu obiectul şi conţinutul său, propunerea legislativă face parte din categoria legilor organice.

6. La articolul 5 după alineatul (7) se introduc trei noi alineate, alineatele (8) – (10) cu următorul cuprins:

„(8) Echipamentele dedicate pentru organizarea jocurilor de noroc trebuie aprobate de către Comitetul de Supraveghere al O.N.J.N., pot fi fabricate de un rezident sau nerezident cu condiția ca producătorul să dețină licență, în conformitate cu prezenta ordonanţă de urgenţă. Condițiile ce trebuiesc îndeplinite, precum și lista cu echipamentele dedicate jocurilor de noroc va fi reglementată prin ordin al Președintelui O.N.J.N.

(9) Site-ul organizatorului licențiat în România să desfășoare jocuri de noroc la distanță trebuie, obligatoriu, să conțină informații în limba română, respectiv: datele organizatorului conform cu înregistrarea sa la Oficiul Registrului Comerțului, inclusiv date de identificare fiscală și/sau un alt număr de identificare, licența emisă de către Comitetul de Supraveghere al O.N.J.N., regulile privind desfășurarea jocurilor de noroc, enumerarea clară și neechivocă a modalităților de acceptare a mizelor, de acumulare și de plată a câștigurilor, suma mizelor și suma câștigurilor, servicii de , date de corespondență – inclusiv un număr de telefon și adresa de e-mail pentru direct și în timp util cu organizatorul, modalitățile de depunere a plângerilor și sesizărilor către organizator și O.N.J.N., precum și alte aspecte ce vor fi reglementate prin normele de aplicare ale prezentei ordonanțe de urgență.

(10) În înţelesul prezentei ordonanțe de urgență, locațiile specializate în care se poate desfășura activitatea de jocuri de noroc, sunt: sălile dedicate de slot-machine, agențiile de pariuri și agențiile loto, cluburile de poker, sălile de bingo și cazinourile. Condițiile ce trebuiesc îndeplinite pentru locațilie specializate vor fi reglementate prin normele de aplicare ale prezentei ordonanţe de urgenţă.”

7.Articolul 6 se modifică şi va avea următorul cuprins:

„Art. 6.- (1) Prin organizator de jocuri de noroc se înţelege persoana juridică licențiată să organizeze și să exploateze jocuri de noroc în condiţiile prezentei ordonanțe de urgență şi a reglementărilor specifice. Poate dobândi această calitate persoana juridică de drept român constituită în condiţiile legii sau persoana juridică constituită legal într-un stat membru al UE, sau în state semnatare ale Acordului privind Spațiul Economic European sau din Confederația Elvețiană.

(2) Poate dobândi calitatea de organizator temporar de jocuri de noroc, persoana juridică, constituită în condiţiile alin.(1) care organizează şi exploatează jocuri de noroc pe o perioadă de 3 luni, în staţiunile turistice, astfel cum sunt definite în anexa nr. 5 din Hotărârea Guvernului nr. 852/2008 pentru aprobarea normelor şi criteriilor de atestare a staţiunilor turistice, cu modificările și completările ulterioare.”

8. Articolul 7 se modifică şi va avea următorul cuprins:

„Art. 7– (1) Prin participant la jocul de noroc se înţelege orice persoană fizică majoră (cu vârsta de cel puțin 18 ani împliniți) care doreşte şi are dreptul legal să participe la jocuri de noroc autorizate în condiţiile prezentei ordonanțe de urgență şi a reglementărilor specifice. Participarea la joc presupune acceptarea necondiţionată a regulamentului respectivului joc de noroc.

(2) Se interzice participarea la jocuri de noroc tradiționale a persoanelor care nu dețin asupra lor acte de identificare cu poză.”

9. La articolul 8 după alineatul (1) se introduce un nou alineat, alineatul (2) cu următorul cuprins:

„(2) Un organizator de jocuri de noroc va fi obligat, în termen de maxim 3 zile lucrătoare, în conformitate cu procedura stabilită, în condițiile și regulile aprobate pentru desfășurarea jocurilor de noroc să achite câștigurile și/sau să ofere premiile în natură, persoanei fizice care a prezentat jetoane, cupoane, bilete sau alte mijloace pentru a dovedi câștigul, dovezi care sunt prezentate material.”

10. Articolul 9 se modifică şi va avea următorul cuprins:

„Art. 9.- Prin jocuri de noroc frauduloase se înţelege acele jocuri de noroc prin care mijloacelor de joc aprobate le sunt modificate construcția, datele sau parametri iniţiali, astfel încât să fie adusă atingere elementelor de şansă sau metodelor de selecţie.”

11. La articolul 10, alineatele (1) și (3) se modifică şi vor avea următorul cuprins:

„Art.10.- (1) Jocurile de noroc se clasifică după cum urmează:

a) jocuri loto, – joc tradițional – dacă sunt folosite rezultatele pur aleatorii ale unor evenimente ce constau în extrageri de numere, de litere, bilete sau simboluri, indiferent de procedurile şi caracteristicile mijloacelor utilizate pentru efectuarea extragerilor (urne, roţi, cupe şi alte asemenea mijloace) care se desfăşoară cu sau fără prezenţa fizică a jucătorilor. În această categorie se includ: loteriile, inclusiv cele instantanee, şi orice joc de noroc care se desfăşoară cu sau fără prezenţa fizică a jucătorilor şi care constă în extrageri de numere, de litere, simboluri, formulare sau bilete, prin intermediul cărora pot fi obţinute diverse câştiguri determinate de evenimente care se desfăşoară cu sau fără prezenţa fizică a jucătorilor, cu excepţia jocurilor de noroc definite în continuare;

b) pariuri, – joc tradițional – dacă sunt folosite rezultatele unor evenimente ce se vor produce fără implicarea organizatorilor. Pariul este un joc de noroc în care participantul trebuie să indice rezultatele unor evenimente ce urmează să aibă loc sau care sunt generate aleatoriu de un sistem informatic independent. În această categorie se includ:

(i) pariurile mutuale, în cadrul cărora premiul se distribuie participanţilor declaraţi câştigători proporţional cu numărul variantelor câştigătoare deţinute de fiecare dintre aceştia, organizatorul fiind implicat doar în procesul de colectare a taxelor de participare şi de distribuire a sumelor stabilite cu titlul de premii, în conformitate cu prevederile regulamentelor de joc respective;

(ii) pariurile în cotă fixă, în cadrul cărora organizatorul este cel care stabileşte pe baza unor criterii proprii şi aduce la cunoştinţa participanţilor cotele de multiplicare a mizei în cazul în care variantele jucate sunt declarate câştigătoare, în conformitate cu prevederile regulamentelor de joc respective. Valoarea fiecărui câştig este fixată prin regulament (sumă fixă sau multiplu de miză) independent de totalul mizelor (în cazul pariurilor organizate de deținătorul autorizației);

(iii) pariurile în contrapartidă organizate în cadrul agențiilor de pariuri, activitate care constă în punerea în corespondență a pariurilor între diverși jucători, respectiv acceptarea unui pariu plasat de un jucător doar în măsura în care se identifică un alt jucător care plasează un pariu în sensul invers celui plasat inițial. Valoarea fiecărui câştig este determinat de jucători (în cazul pariurilor intermediate de organizator);

c) jocuri de noroc caracteristice cazinourilor, – joc tradițional – dacă evenimentele se produc cu ajutorul unor mijloace specifice de joc, în prezenţa fizică a participanţilor, cu sau fără participarea directă a acestora. Mijloacele specifice de joc folosite pot fi: cărţi de joc, zaruri, bile de ruletă, rulete şi mese de joc, aparate de joc, inclusiv instalaţiile auxiliare ale acestora, precum şi alte mijloace de joc stabilite prin normele de aplicare ale prezentei ordonanțe de urgență;

d) jocuri de noroc caracteristice cluburilor de poker – joc tradițional – sunt jocuri de noroc cu cărţi de joc, denumite „poker” care se desfăşoară exclusiv între participanţi în săli (locaţii) specializate.

e) jocurile tip slot-machine: – jocuri tradiționale – de două tipuri, respectiv:

(i) slot-machine dacă evenimentele sunt organizate în prezenţa fizică a participanţilor prin intermediul maşinilor, utilajelor şi instalaţiilor specifice, care vor fi operate în locații specializate în care se poate desfășura activitatea de jocuri de noroc, iar câştigul este nelimitat și depinde de hazard, și

(ii) aparatele electronice atribuitoare de câștiguri cu risc limitat, dacă evenimentele sunt organizate în prezenţa fizică a participanţilor prin intermediul maşinilor, utilajelor şi instalaţiilor specifice, care nu vor fi operate în locațiile specializate în care se poate desfășura activitatea de jocuri de noroc, iar câştigul este limitat și depinde de hazard;

f) jocurile bingo desfăşurate în săli de joc – joc tradițional – cu câştiguri generate de elemente aleatorii, organizate prin folosirea echipamentelor complexe de extragere de tip loteristic, care sunt caracterizate prin extrageri şi premieri succesive, în prezenţa fizică a jucătorilor;

g) jocurile bingo organizate prin intermediul reţelelor de televiziune, – joc tradițional – cu câştiguri generate de elemente aleatorii, organizate prin folosirea echipamentelor complexe de extragere de tip loteristic, care sunt caracterizate prin extrageri şi premieri succesive, fără prezenţa fizică a jucătorilor.
