Firstly because it is an event dedicated to the issues of our gambling industry. We’ve been doing this for 10 years at the end of each year, where together we take an x-ray of 2022 and a projection of what’s to come in 2023.
This year marks the return of representatives from the National Gambling Office to RPG. We are delighted about this. Mihail-Silviu POCORA, Vice President (exercising the powers of President) of the National Gambling Office will give a retrospective and a presentation of the situation of the Romanian gambling industry in 2022. Mr. Pocora will answer your questions and will try to clear up many of your doubts about the legislative, regulatory and control side of the institution.
On 2 November 2022, the draft law amending OUG 77/2009 on the organization and operation of gambling was adopted and published in the Official Gazette, amendments which require gambling operators to keep electronic records of all persons entering the premises where gambling is organized, as well as to archive electronic databases of self-excluded and undesirable persons and to keep them for at least 5 years after their establishment. These changes will have a considerable impact on gambling organisers in Romania.
This introduces a new condition for obtaining an operating licence, economic operators in our industry will be obliged to prove the existence of a technical infrastructure for the establishment of databases of self-excluded and undesirable persons. Failure to comply with the new amendments will make it impossible to obtain the operating licence, as operators will be obliged to prove the existence of the technical means to draw up a database of undesirable or self-excluded persons.
Also, for failure to comply with the provisions of Article 16 of OUG 77/2009 (article introducing this new obligation), the Supervisory Committee of the ONJN may order the revocation of the gambling licence, according to Article 17 para. 2, letter i.) of OUG 77/2009.
Also, in RPG 10 we will discuss the amendments that were made on July 15 by OG15 by the Government to OUG 77/2009 and that must be approved in Parliament in November because it is an organic law and needs its approval, the Chamber of Deputies is the decision-making chamber, the vote in plenary will be there too, but the decisive report will be made by the Budget-Finance Committee of the Parliament…Interestingly, at the time of writing this article, this legislative document already has a negative opinion from the Legal Committee of the Chamber of Deputies!
