Even if the phenomenon is described by some as “the dark side of sport betting”, taking an accusatory stance on the uncontrolled rise of Daily Fantasy Sports Betting, we cannot deny the spectacular rise of this form of bets neither can we obstruct the immense benefits that it brings to those who want to develop new businesses in gambling. Last but not least, important benefits are also brought for the sports fans who thus have the chance to immerse within the secrets of their favorite sport by engaging in a virtual world. Daily Fantasy Sports (DFS) means millions of dollars placed in bets, a new open market for advertising, but also many scandals related to the legality of this type of betting as well as their juridical framework. Are these concerns legitimate or on the contrary this phenomenon should be encouraged? How does the virtual world of sport betting work?

This industry reached an enourmous value – it now brings incomes of $2 billion/ year, and the Eilers Research company estimates that the value of bets places on DFS will reach $2.6 billion in 2016, while projecting an annual increase of 41%, so that in 2020 the industry will reach the value of $14.4 billion. In 2016, 51 million people in Canada and USA have played DFS, a 25% increase compared to 2011.
The main difference compared to other types of fantasy games is that DFS offers cash prizes that can be withdrawn in the same day. The two biggest players in the United States market, FanDuel and DraftKings, will together pay a total prize pool of one billion dollars in prizes to players during the year 2016, while tens of millions of dollars will be directed to commercials, in order to continue to attract new players and thus more incomes. DraftKings, for example, has budgeted investments of $250 million in commercials in the next two years, all the money being directed towards the biggest TV channel dedicated to sports in the USA, ESPN. The rationale behind this investment also implies winning the competition with the biggest competitor in the industry, FanDuel.
Even if the fantasy sports industry went through a meteoric rise both in incomes and investments, the most recent debates about this type of bets approaches its inclusion within the field of gambling. Nevertheless, casino operators in Vegas are becoming increasingly worried regarding the impact these games could have over millions of clients that will increasingly bet on mobile and give up on casinos and parlors. Those who this industry claim that sites dedicated to the fantasy sports betting domain can legally pay their clients, as at the governmental level fantasy sports are not included in the vast area of what is called gambling.
In the United States we have recently witnessed a big scandal regarding the legality of these activities. Big companies activating in the Daily Fantasy Sports field have brought to light a new subject regarding the way in which we define sports and what does gambling mean now in the era of mobile, thus questioning the validity of federal laws in gambling when applied to fantasy sports. In fact, in states like New York, Alabama, Illinois and Texas – to name but a few – there has been a surge in offensives coming from federal authorities against these types of bets. Of course, there are an increase in the number of voices claiming that the fantasy version of sports betting is based more on skill and math than on luck/ chance, but it is not here where the legal issue lies. The general prosecutor of the state of Illinois gave a clearer explanation: “Lack of legislation meant to exempt daily fantasy sports contests from the legal provisions applying to gambling, from my point of view means that Daily Fantasy Sports still remains an illegal form of gambling under the laws of this state”. Well, this means that “forms of gambling that are not specifically recognized by the stat are illegal”. We are speaking thus about a legal vacuum that could push this kind of betting at the limit of legality in more and more American states.
In the end, we can say that even if it still encounters many legal problems and it is still regarded as a pariah inside the industry, Daily Fantasy Sports represent a new form of escapism dedicated to gambling, and the magnitude of this industry makes it impossible to be ignored or limit. Daily Fantasy Sports (DFS) înseamnă așadar miliarde de dolari puși ca pariuri, un nou debușeu pentru publicitate, dar și multe scandaluri legate de legalitatea acestor tipuri de pariuri și încadrarea lor legislativă. Sunt legitime astfel de îngrijorări sau fenomenul trebuie încurajat? Cum funcționează lumea virtuală a pariurilor sportive
Conceptul a fost dezvoltat în urmă cu cinci ani în SUA, de când a luat un avânt tot mai mare, iar în Marea Britanie există deja o ligă fantasy de fotbal, în timp ce în Statele Unite există jocuri de fantasy sports pentru principalele sporturi americane, cum ar fi baschet (NBA), fotbal american (NFL), baseball, hockey, golf, tenis, Formula 1, dar și pentru curse de cai sau arte marțiale. Ideea principală care trebuie cunoscută de profani este că jucătorii trebuie să își creeze o echipă, numită în această industrie ”fantasy team”, care va fi compusă din jucători activi dintr-un anumit sport. Apoi, echipa poate avea acces în liga virtuală a sportului respectiv, iar punctele se acumulează pe baza performanței pe care sportivii aleși o au în jocuri/partide reale, respectiv în turnee și nu numai.
Cele mai mari ligi de acest fel sunt istrate de diverse site-uri, multe dintre ele având sute sau mii de membri. Echipa aleasă de un jucător concurează împotriva altor echipe, iar pariurile se fac practic pe felul în care va performa o echipă sau alta. Sigur, opțiunile de pariuri diferă în funcție de sportul ales, de aceea este foarte importantă cunoașterea apriorică a regulilor. O regulă comună multor sporturi este aceea că nu se pot alege prea mulți jucători de la aceeași echipă, așa ca va fi imposibil de replicat o echipă ca Real Madrid, de pildă.
O industrie cu multe zerouri
Această industrie a ajuns la o valoare foarte mare – în prezent ea produce 2 miliarde de dolari/an, iar compania de cercetare Eilers Research estimează că valoarea pariurilor pe DFS va ajunge la 2.6 miliarde de dolari în 2016, prognozând totodată o creștere anuală de 41%, astfel încât până în 2020 industria va avea o valoare de 14.4 miliarde de dolari. În 2015, 51 de milioane de oameni din Canada și SUA au jucat DFS, în creștere cu 25% față de 2011.
Diferența majoră față de alte jocuri de tip fantasy este că DFS oferă premii cash care pot fi ridicate în aceeași zi în care sunt câștigate. Cei mai mari doi jucători de pe piața din Statele Unite, FanDuel și DrafKings, vor plăti împreună în jur de un miliard de dolari ca premii către jucători în 2016, în timp ce zeci de milioane de dolari vor merge către publicitate, pentru a atrage în continuare noi jucători, deci noi venituri. DraftKings, de exemplu, și-a bugetat investiții de 250 de milioane de dolari în publicitate pentru următorii doi ani, suma fiind alocată celui mai mare post tv dedicat sportului din SUA, ESPN. Această investiție vizează câștigarea competiției cu principalul concurent din industrie, FanDuel.
Chiar dacă industria de fantasy sports a cunoscut o creștere meteorică atât în venituri cât și în investiții, cele mai recente dezbateri despre aceste tipuri de pariuri vizează apartenența lor la domeniul gamblingului. De altfel, operatorii de cazinouri din Vegas sunt tot mai îngrijorați de impactul pe care aceste jocuri îl pot avea asupra a milioane de clienți care vor paria direct de pe telefonul mobil și vor renunța la cazinouri sau sălile de jocuri. Apărătorii acestei industrii spun că site-urile dedicate domeniului fantasy sports betting își pot plăti în mod legal clienții, pentru că la nivelul guvernului fantasy sports nu sunt asimilate domeniului jocurilor de noroc.
În Statele Unite, s-a iscat recent un mare scandal în legătură cu legalitatea acestor activități. Marile companii de Daily Fantasy Sports au adus în lumina reflectoarelor un nou subiect legat de felul în care definim sportul și ce înseamnă de fapt gamblingul în era dispozitivelor mobile, chestionând validitatea legilor federale privind gamblingul pentru domeniul de fantasy sports. De altfel, în state precum New York, Alabama, Illinois sau Texas – pentru a numi doar câteva – a fost declanșat o ofensivă la nivelul autorităților împotriva acestor tipuri de pariuri. Sigur, tot mai multe voci spun că varianta fantasy a pariurilor sportive se bazează mai mult pe pricepere și calcule decât pe noroc/ șansă, însă nu aceasta este problema legală. Procurorul general al statului Illinois a dat o explicație mai clară: ”Lipsa legislației care să excepteze concursurile de fantasy sports de la prevederile legate de gambling, înseamnă din punctul meu de vedere că Daily Fantasy Sports constituie o formă de gambling illegal sub legea din acest stat”. Ei bine, asta înseamnă că ”formele de gambling care nu sunt recunoscute specific de către stat sunt ilegale”. Vorbim așadar de un vacuum legal care ar putea împinge aceste pariuri la limita legalității în tot mai multe state din SUA
În final, chiar dacă întâmpină multe probleme legale și sunt încă văzute ca un fel de paria în cadrul industriei, Daily Fantasy Sports sunt o nouă formă de escapism dedicată gamblingului, iar magnitudinea acestei industrii o face imposibil de ignorat sau de limitat. Celor care sunt dispuși să lupte pentru democratizarea în cadrul industriei de gambling, nu le putem spune decât: aux armes!
