The draft law regarding the prevention and fight against money-laundering has created the industry’s largest migraine in 2018, according to Doru Gheorghiu, executive director of the Romanian Bookmakers – The Patronage of Betting Organizers in Romania. The vocational associations have however address this threat and many others in a happy and unitary manner. About this and what is to be expected of 2019, all within one interview which comes as a complete x-ray of a solicitor and a useful prediction for the operator with regards to 2019.

Which was the greatest challenge of 2018 for the gambling industry?

From the point of view of the professional representation, clearly the most important mission was that of the dialog with the legislative body with regards to transferring Directive EC 849 / 2015 regarding the prevention and fight against money laundering and terrorism financing into national regulations. According to the initial formulation of the draft law associated to this transfer into the national regulations, the traditional gambling operator would have been faced with an operational effort which would have practically been impossible to realize. I’m referring here to the requirements of implementing the standards measures for clientèle identification. The parliamentary commissions have, however, appreciated the arguments brought by us within the debates and proceeded to amending this draft law with sentences adapted to the practical realities of operating traditional gambling activities. As such, what was expected to have a devastating impact upon the retail sector no longer represent a threat.

Which would be the most important transformations through which the industry has went during this almost-ending year?

The online sector continues to find itself in full swing, an expansion which I believe will manifest itself next year, as well. Then, I’ve observed an ever-growing interest for the social responsibility area, respectively toward ing the activities of the Responsible Game Association more and more practically. More and more decision-factors from profile companies understand that ing this Association and its projects means ing the sustainability of their own business. In this context, I am sure that we will see Responsible Game with project which will have an even greater impact than that of current projects, in 2019.

How do you evaluate the industry’s professional representation in 2018?

It is very important that we, those in the area of patronage activities, have sought a most efficient shared work manner for achieving our objectives. More and more actions have benefited from a conjugated effort and there no longer were mission assumed only by the Romanian Bookmakers, Rombet, Romslot, AOPJNR or Exprogame. I hope I haven’t forgotten anyone…

You’ll find aspects with which each of these organizations have contributed in almost all of the industry’s representation enterprises. I salute the fact that this responsibility to form a common front has come to life and that, given that predictions say that 2019 will not be exempt from the rattle of legislative changes, this union of efforts must continue and we must win as much as we can with regards to effectiveness within this circle which I can already name a strong team of professional representation.

Considering that you mentioned 2019… What do you think the challenges of next year shall be?

I think that we will have to concentrate on improving the industry’s relations with the local communities within which it operates as a commercial activity and to address harmony as much as we can. I foresee, unfortunately, that we will be faced with even more local initiatives to restrict gambling on various levels, initiatives which can transform in drafts for amending the national regulation framework. As such, I believe that it is high time that we, the industry, answer the requests of the local istration and to address these requests by collaborating with the istration.

How do you appreciate the recent regulations on prohibiting the promotion of jack-pot values and of goods offered within promotional campaigns at the level of GEO 77/2009?

I have understood very clearly how these will be interpreted by the ONJN representatives, from how we’ve been told by the leadership of the Office within the dialog held with the Advisory Council of the ONJN. However, so that operators are clear on how to formulate their promotion messages, as well as on the manners in which to expose said promotions, I have sent the ONJN a set of clarification questions. These have been collected from operators and sent to the Office with the request that the answers be published on the authority’s portal, so that they may be accessible for consultation to all companies.

Proiectul de lege privind prevenirea și combaterea spălării banilor a provocat pentru industrie cele mai mari migrene în 2018, conform lui Doru Gheorghiu, director executiv al Romanian Bookmakers – Patronatul Organizatorilor de Pariuri din România. Asociațiile profesionale s-au adresat, însă, fericit și unitar acestei amenințări și multor altora. Despre aceasta și despre ce ne rezervă 2019, într-un interviu care vine ca o radiografie completă a unui an solicitant și ca o previziune utilă operatorului privind 2019.

Care a fost marea provocare a anului 2018 pentru industria jocurilor de noroc?

Din perspectiva reprezentării profesionale, în mod clar cea mai importantă misiune a fost reprezentată de dialogul cu legislativul pe modul de transpunere în reglementările naționale a Directivei CE 849 / 2015 de prevenire și combatere a spălării banilor și finanțării terorismului. În modul în care a fost inițial formulat proiectul de lege aferent acestei traspuneri, operatorul de jocuri de noroc tradiționale s-ar fi confruntat cu un efort operațional practic imposibil de îndeplinit. Mă refer aici la obligațiile de aplicare a măsurilor-standard de cunoaștere a clientelei. Comisiile parlamentare au apreciat însă drept obiective argumentele aduse de noi în dezbateri și au procedat la amendarea acestui proiect cu enunțuri adaptate la realitățile practice ale operării de jocuri de noroc tradiționale. Astfel, ceea ce se prefigura a avea un impact devastator asupra sectorului de retail nu mai reprezintă în prezent o amenințare.

Care ar fi cele mai importante transformări pe care le-a suferit industria în anul care stă să se încheie?

Sectorul de online continuă să se regăsească în plin avânt, o expansiune care cred că se va manifesta și în următorul an. Apoi, am constatat o tot mai mare preocupare a operatorilor pentru zona de responsabilitate socială, respectiv spre a susține tot mai concret activitățile Asociației Joc Responsabil. Tot mai mulți dintre decidenții din companiile de profil înțeleg că a susține această Asociație și proiectele sale înseamnă a susține durabilitatea propriei afaceri. În acest context, sunt convins că vom regăsi Joc Responsabil cu proiecte de un și mai mare impact decât cele din prezent, în 2019.

Cum evaluați reprezentarea profesională a industriei în 2018?

Este foarte important că noi, cei din zona activităților de natură patronală am căutat un mod cât mai eficient de lucru în comun în îndeplinirea obiectivelor noastre. Tot mai multe acțiuni au beneficiat de un efort conjugat și nu au mai fost misiuni asumate doar de Romanian Bookmakers, Rombet, Romslot, AOPJNR sau Exprogame. Sper că nu am uitat pe nimeni…

În cam toate întreprinderile de reprezentare a industriei veți regăsi aspecte cu care a contribuit fiecare dintre aceste organizații. Salut faptul că s-a instaurat această disponibilitate la a face front comun și cred că, de vreme ce nici 2019 nu se prefigurează ca fiind un an foarte liniștit din perspectiva modificărilor de legislație, această reunire a eforturilor trebuie să continue și să câștigâm cât mai mult în eficiență în cadrul acestui cerc pe care îl pot numi deja o echipă redutabilă de reprezentare profesională.

Pentru că tot ați amintit de 2019… Care anticipați că vor fi provocările următorului an?

Cred că va trebui să ne concentrăm pe a îmbunătăți relațiile industriei cu comunitățile locale în care aceasta se manifestă ca activitate comercială și să ne adresăm cât mai mult armoniei. Prevăd că, din nefericire, ne vom confrunta cu tot mai multe inițiative de anvergură locală de restricționare pe diverse planuri a jocurilor de noroc, inițiative care se pot transforma în proiecte de modificări ale cadrului de reglementare de nivel național. Prin urmare, cred că este vremea să venim noi, industria, în întâmpinarea doleanțelor istrației locale și să ne adresăm acestora prin colaborare cu istrația.

Cum apreciați recentele reglementări de interzicere a promovării valorilor de jack-pot și a bunurilor oferite în promoții intervenite la nivelul OUG 77 / 2009?

Am înțeles foarte concret cum vor fi acestea interpretate de către reprezentanții ONJN, după cum ne-a fost expus de către conducerea Oficiului în cadrul dialogului din Consiliul Consultativ de pe lângă ONJN. Totuși, pentru a fi foarte clar operatorilor cum să își formuleze mesajele de promovare, precum și modalitățile de expunere a acestora, am transmis ONJN un set de întrebări de clarificare. Acestea au fost colectate de la operatori și transmise Oficiului cu rugămintea ca răspunsurile adresate să fie publicate pe portalul autorității, astfel încât să fie accesibile spre consultare tuturor companiilor.
